Hit Another Road Block With My T Shirt Company Nam

so after deciding my dream is to open a t shirt/clothing company and endless name changes and logo problems, I though it finally had it. I came up with the name "Gifted Minds" I made a custom Logo with a Cartoon Brain wrapped in a bow making is seem like the mind is a gift. I finally thought everything was in place great creative unique name, with a easy clever matching logo, a positive and unique theme, and I had about 40 detailed T-shirt designs already drawn up. after all of this for the first time in almost 2 years I thought to myself things are going in the right direction finally until my attorney said we were good on the trademark end of things after an extensive search, but another company came up as Gifted Miinds Entertainment on a copyright (but not trademarked). that is a entertainment company that specializes in music and art but sells hats and shirts also. so now it looks like there's no way around this but to start over AGAIN. can anybody help me with some suggested names that's similar or that would go with my logo? anything helps

    Do you have a business plan and a marketing plan? Who is your primary target audience? Where? What makes your t-shirts unique? Why would someone want to buy them? How will your target audience know you exist?

    Without the answers to these questions (and perhaps a few more), coming up with a name is going to be a very frustrating exercise. How will we know what the objective is supposed to be? Do you have a Creative Brief?

    yes target audience is ages 16-35 urban wear, location anywhere (I live in nyc) and what makes my brand unique from other is its all custom designs drawn from an actual artist. and the theme of the brand is Idioms and Metaphors not just useless cool looking designs. every shirt has a unique custom design on the front, with a descriptive metaphor or idiom on the back matching the picture. the brand is about using your mind being creative and staying positive. I named it gifted minds because I was often wondering to myself if I had any talents or skills and it was depressing. I couldn't sing, couldn't dance, not nearly athletic to make it professional, nothing stood out to me as a god given gift, until I though about my mind and the possibility to be creative, and inspire others that thought like me that every one has a gift which is their Mind!

    There is one simple way to determine what name you should use. Put it to the test.

    Set up a very simple adwords campaign for tee-shirt design (or somesuch) - and just keep to the absolute essentials. A quick landing page (and it needn't even be your own ... ) and your three choice names each as the headline. The rest of the ad's just there as padding.

    The one with the most clicks wins.

    And that's it.

    No plans, no head-scratching, no lawyers ... until later when you're establishing your name. At most it'll cost you $100.

    Imagin8tion is clever I like that one as well. can I still trademark my name if someone else is using it but not registered? like this other company is using Gifted Miinds but didn't return a hit when we searched the Trademark database. so even though they are selling and operating under "Gifted Miinds" if we went ahead and got approved through the USTPO to TM it could they potently sue me even though they are not trademarked?

    Trademarks can be created without registration through actual use (the TM mark is a notification of an unregistered trademark). Your lawyer should know if this will cause problems with your application. Infringement of an unregistered trademark is known in the UK as 'passing off'. Proving someone is passing-off is more difficult to achieve legally, than simply showing registered trademark infringement.
