New Canadian Anti-spam Legislation

Posted by tcgren on 250 Points
I'm interested in everyone's perspective on the new Canadian anti-spam legislation (CASL) taking effect on July 1, 2014 which is significant in breadch, scope and penalties (up to $10mm), and further significant actions taking effect in 2017.

How high in priority is this in certain busineses and what does it mean for future e-marketing or even upselling/cross-selling going forward? How easy is it truly to avoid sending to Canadian residents if they aren't on a Canadian web-based email system (i.e. yahoo.co.ca or gmail.co.ca)?

    A few thoughts:

    1. Most marketers are probably not even aware of the legislation, or they think it doesn't apply to them.

    2. Until there's a high-profile action with serious penalties for violation, the legislation is likely to remain invisible.

    3. Most ethical marketers don't spam and probably don't need to worry too much about the legislation, or can easily comply, if they don't already.

    4. Are there some marketers who ought to worry about CASL 2014? Absolutely. They are mostly the ones who give marketing a bad reputation today.

    Mgoodman,
Thanks for your contribution to my question. I'm disappointed more didn't opine but I think that will change when this becomes front and center after a high-profile situation occurs in the market.
