Stock Photo Usage

Posted by angiedaschel on 25 Points
I need some direction on stock photo usage. I have purchased photos from a stock photo website. I have created brochures using these photos, and posters as well. Now, customers of our company (a laboratory) want to promote that they use our lab, and want to re-post our brochures and posters online. Is this in violation of the "non-transferable" verbiage in the license or is this within normal use of the stock photo in it's "end use" as a brochure or poster?

Possibly. By transferring the images, you transfer the rights to reproduce those images. Check the small print and contact the stock house to get clarification in writing.

Can you hire a photographer to shoot new photos, replacing the stock photos?

If the client if re-posting your branded brochures, then chances are that it won't be a violation.

But if they are making something under their name with the same art, then it would (and the solution would be for them to also purchase the art).

As said above, it might be best to contact the source. Each stock art site has their own rules and regulations, so bets to be sure what yours says.
