Need Guidance On Laws For A Trade Show Giveaway

Posted by victoria on 500 Points
I am going to a major show in Vegas. I intend to gather names and do a drawing. The drawing will be conducted in Texas. Which state laws would apply and are there any requirements I need to fulfill legally? Do I need to post terms and conditions?

thank you!

Your 100% best bet is to hire a lawyer to draft documentation for you. But they're expensive, so turn to your next-best-bet.... Google. I just did a quick search and found a few good FREE resources to start you off and decide how much due diligence you need to do to keep from causing legal headaches.

    https://www.lfirm.com/CM/MarketingLawBasics/Sweepstakes-Law-Basics.asp

    https://www.office.com/templates/page3.asp?docid=51

... And those are just the first few I clicked on from page one. Definitely read up as much as you can before you decide whether or not to get a legal team involved. But if you can afford it, I'd definitely consider it. I've heard some horror stories from conducting a sweepstakes without any legal specifications coming back to bite you in the... well, you get the idea.

I'm not a promotional sweepstakes lawyer, here is one, https://www.reedsmith.com you might find it covered in their sister info site, https://www.adlawbyrequest.com , but personally I would either do one of two things, make it skill based give-a-way so it's not a game of chance, or do like most people do, not worry about it and just do it.

Thanks, I looked on the mighty Google but perhaps my search term was not good enough. I have thought of the 'just do it' tactic but I want to make sure I get invited back ;).

Its just good CYA to post the terms and conditions. There are quirks in local states-- but you can get too anal on these details. While your show is major, your drawing probably isn't going the route of "Publishers Clearing" and if you run a legit program-- there is nothing for anyone to complain about.
