Need Info On Trademarks And Patents

I am a Designer and Music writer I can Design everything from Clothes Shoes Mosaics and Jewelry and Pottery and Crystal I already have My Company Name for my Design Co I am about to start a LLC I have decided to create my Jewery, Mosiacs and Write my Music first Question number one I dont have the money to manufacture my own Jewelry How can i sell my idea about my products to a manufacturer for mass production without them stealing my Designs Would I need a Patent ? Who would i contact for a patent For jewelery Designs ? and how much would it cost? I would Like the same info about My Mosaics Designs As for my Music I also have a Company name for it also which i am about to incorporate too Right Now I am in the process of connect with a Entertainment Lawyer But how can i shop my Material to A&R and Music Companies how can i connect with them

    What you're asking is essentially the meat of a business plan, in this case, two businesses, so two business plans. I suggest you pick one and concentrate on it. If you don't have money to support even one business, you'll fall doubly into a hole with two businesses. My recommendation is to go with your music because it doesn't cost anything to create it except for your time and some paper (assuming you actually write the music to music sheets). You claim to not have money for the materials you need for creating jewelry, so the choice should be obvious.

    Everything will fall into place once you begin to develop your business plans. There are many, many resources and tutorials online concerning business plans.

    Answer: You cannot patent an idea. Go to Nolo.com and learn as much as you can about copyrights, trademarks (and service marks), and patents so you can understand what each of these protect. Never give your ideas to anybody without an explicit contract and other documents that evidence your ownership of the intellectual property because, yes, many manufacturers will take your idea. It's very easy to say they had that idea and were ready to produce it.

    You ask about patents, and how much it would cost. The answer is that it's very expensive. Most of the expense is on legal fees. You're talking in the neighborhood of $15,000, depending on where your lawyer is located and whether he's a solo attorney or works in a large expensive law firm. I'm being conservative about the expense, by the way. You might be able to get it less expensive if you find a senior paralegal who is experienced in patent law and patent filings. Or you can do it for solely the cost of the patent filing fees if you're a quick study and you learn how to patent an invention and you do it yourself. I for one wouldn't trust the companies that advertise they'll get a patent for you and all you have to do is to tell them what your invention is. They may be legitimate, but it's not a risk I would take.

    Ask the Entertainment Lawyer you say you'll be speaking with. One of the perks of getting high-level, expensive lawyers is that they have access to high-level celebrities who are their clients, as well as access to agents, producers, etc. If you pay them well and you tell them that you need to connect with A&R and music companies, they'll be only to glad to separate you from your money.
