Terms And Conditions For Competitions In Hong Kong

I am considering running a competition for Pharmacist in Hong Kong. The pharmacists would need to answer questions regarding a particular product. The competition would be mailed to the pharmacist or handed to them by a sales person.

Does anyone know how I can find out what the terms and conditions should be for this style of competition in Hong Kong. Also, if a lottery license or any other requirements.

    A competition (like a sweepstakes)? How about using the language from a similar sweepstakes. You really should have a lawyer in HK look over the details though, because this forum is for marketing not legal advice.

    You need local information from an informed source. HK law is either derived from the UK or it is imported from China. In the UK you would need a license for a lottery and likewise in China but it is governed by a number of caveats to allow small scale lotteries to be run for charitable purposes.

    The problem with getting it wrong is that it then becomes a crime and in HK the criminal law is over-ridden by the Chinese authorities - hence it can be quite harsh.

    It moral is that it is not worth risking getting it wrong – consult either your local chambers of commerce of if you know a member a local Hong or, for example an employee of Jardine Matheson which used to be synonymous with the law in any case!

    You may be well advised to deal directly with government agencies in Hong Kong so that you remain on the right side of the law at all times. The last place you want to wind up in is a Chinese jail.
