Do I Need A License?

We have a specialty cake and cookies made with an old recipe from our ancestors in Guatemala. It is like a pound, cake or coffee cake. Our question, do we need to have a license from the food and drug administration in order to market these products? Please help.

    Yes and no. Depends on where you're selling them. At a farmers market...check with you county health department. If just to friends...no worries.

    I don't think you need a license to *market*, but you will need to meet certain criteria in your baking facility to MANUFACTURE the cakes/cookies.

    You may also want to consider a trademark for the name you will use to identify the product.

    The real issue is what you really plan to do, and how broadly you plan to market your product(s).

    Best to speak with a lawyer about this. It's not worth the risk to make these kinds of decisions based on what a bunch of marketers think.
