Newsletters Without Mailing Address

Posted by Anonymous on 125 Points
Hi-I need clarification. I want to use a mailing list to send news to my subscribers. My host does not have mailing list software so I have to use a third party mailing list service to collect addresses and send out mailings. So far, I found that in order to use them I must provide a PO mailing address at the bottom of each email I send out. This is because of the CAN-SPAM act. I have received email newsletters that do not feature a PO mailing address, so I'm confused. How is that they were able to bypass the PO mailing address requirement? To clarify, the emails are not posts from a blog, but crafted especially for a mailing list.

Thank you for any enlightenment you can provide.

There will always be mailers that ignore some regulations of the CAN-SPAM act, and it's no surprise that they aren't caught, given the vast volume of marketing emails and enewsletters blasted every day.

Some violations may be relatively trivial, though I would never advise ignoring any of the regulations. And not just because they are required--rather, because some violations, and this is one, can negatively impact your results. This is one.

If you do not include either a street address or a PO Box, as required, your email will be perceived as spam by many recipients as well.

Your reputation will be tarnished, your responses will suffer, and you will be part of the problem.

It's not worth the risk. Don't do it.

The rules for CAN SPAM are published .... you're safer, rather than ask what we think or how we interpret it.

Thank you very much for your responses. I agree, it's safer to do it than not at all, especially I don't need the hassle.
