I work for owners of several apartment communities. They have asked me to research whether we can include video of surrounding businesses in our marketing video of the apartment community. For example if there is a McDonalds or Applebees next to the apartment can we shoot video of that business and include it in our ad.

    You can't show other companies (buildings/logos) in your video without express written consent to do so.

    Ever notice on Music Videos they blur out the logos on T-Shirts? Same issue.

    Tell them what you are going to do-- and ask for something in return. You are promoting their location-- I wouldn't give them free advertising.

    I actually think that if it is just background in the video it is fine. Like if you have footage of someone walking around the complex and there is an Applebees in the background that is fine I would think. News reporters use video like this all the time and don't blur anything out.

    Anything in public view is just that... public.

    The reason people blur out the logos in music videos is not for legal reasons, but because they do not want to promote a company (like Nike or Reebok) unless they pay money. If Nike would pay them to be in the video, they would unblur it.

    It sounds to me as though you are making simple marketing videos to show to prospective clients. I am guessing these are not going to be broadcast?

    Personally, I don't think you have any problems but carol Blaha has a good point.

    Simple solution is talk to the managers of the store sin question and explain what you are doing.

    In fact, these stores also derive a great deal of benefit from you putting up a new condo building in their catchment area and your tenants will increase their business revenues.

    Therefore, just be a good neighbour and develop a nice business community in your area and have a cup of coffee with other business managers who might well even be willing to throw in some sponsorship to your deal :)
