Use Of Corporate Logo By Third Parties

Posted by Anonymous on 250 Points
As a public company we have 6 subsidiaries which legally use our corporate identity (logo and company name) on stationery such as business cards and letterheads. However, in the group we also manage - without having a financial stake in them - 3 companies that complete our product range. When registering the company with the stock exchange only the first six are included (integral part of our bottom line), but not the 3 outsiders. My question: can these 3 companies use the same corporate identity as the legit 6 above, i.e. the same visual identity as the registered public company, on their stationery? If not, how can we relate them to the registered public company without infringing the legal aspects?

Look forward to a positive reply from the experts. In anticipation, thank you.

My clients go through an intensive process of defining all those questions with trademark legal experts.
You have to separate the branding issues including the pros and cons, from the obvious legal matters involved.
Before you embark on anything at the marketing level, check the legal status of each of the entities you mentioned, and their relationship to each other.

We are a Gold Microsoft Partner in the Philippines. Microsoft has no financial stake in our company and our partnership is a resellership arrangement. Being such, we are allowed the use of the Microsoft logo, Microsoft Dynamics logo, Microsoft partner logo and other product logos in our materials. There are legal restrictions as well as protective clauses for Microsoft which are in the agreement that we sign with them. I do not know the extent of your "subsidiary" arrangements with the outsider 3 but perhaps you can utilize this kind of an arrangement as a reference model.
