Commission To A Fired Employee

If an employee is fired for misconduct, how long would you continue to pay that employee for an account that he worked on? The employee was fired for choking a female staffer. The employee sued in a small claims court and was awarded $1000 for two months. But now claims he is owed for 20 years.

    This is a very serious situation with major and possibly dire consequences. The answer to your question also depends on geography - in which country you are - because contract law varies from country to country. It also depends on your specific agreement with the individual. While we may have someone on this forum may have had a very similar situation in your country and/or may be an attorney, this would be a long shot. And how would you or the respondent know? You didn't include any specifics on the agreement nor on where you are. I strongly advise you take your situation to an attorney immediately.

    I do not know of anyone who has got commission for anything longer than 6 mos after termination-- by either party. Only if in writing. Otherwise- you are entitled to the commision for the orders you have placed.

    What agreement do you have in place prior to employment- and if you are asking this ?? it means none. Or it means you are exposed.

    Get a lawyer. File a charge against him for assault. Don't get mad-- get even.

    Back to court. If there's nothing in the contract you should lawyer up.

    As someone who's got a lot of experience in construction-- a very litigatious field-- they expect you to p-- your pants once someone says the " L"-lawyer word. Talk to a pro. They are counting on you making a mess in your panties
