Graphic Artist Account List

I employ a freelance graphic artist who has picked up a client with many characteristics of one of my company's key accounts.

I do not have a non-compete in place.

Our ads include promo ideas and offers, which the competitor could easily put in place.

If my client catches wind of my graphic artists working for a competitor, I will lose the account and his trust as a friend.

I'm a two person outfit.

    I feel like I have stepped in it, but not knee deep.

    I just had a conversation with the artist and asked him to stop all production.

    My next step is to implement the non-compete/non-piracy form and learn from this moment.

    Randall is 100% correct. You should absolutely insist that your graphic artist be bound by the same non-compete and non-disclosure rules that bind you. And if you don't have these in force, you need to act immediately and with resolve to fix things quickly.

    You have unwittingly betrayed a client confidence (whether explicit or implicit), and that can haunt you -- and damage your reputation -- for years. You need to grab the proverbial bull by the horns without delay.

    I've seen my error. It was upsetting to see the competitor on the screen of my graphic artist.
