How To Protect My Specific Product

Posted by Anonymous on 250 Points
oh my gosh ive done so much reading and the problem im having is that i cant figure out what applies to my situation...

my product is simply a line of those "livestrong" silicon wristbands, targeted to a really specific niche. they have generic words or phrases that in and of themselves are not likely to be able to be trademarked or anything

so im sure copyright law is not what im looking for, but there must be someone that can point me in the right direction

i just dont want someone else to be able to make the same wristbands for the same purpose targeted to the same niche market

any help is greatly appreciated

    this is very helpful

so im afraid that my problem is this:
even with an agreement with the manufacturer, anyone can go online and find a million silicon wristband manufactures, and still have the same product made.

i essentially handle the distribution as the product is sold on shelves in very small mom and pop type local retail stores that target the same niche as I do

now i spose it would behoove me to have exclusive agreements with each and every individual mom-and-pop store (altho i have no idea how to how to go about that, do the agreements need to be for a certain length of time? and the longer the better for me?)

You can protect yourself if you're willing to have a lawyer on retainer to protect your copyright. From a sales perspective, you build a relationship with the mom-and-pops, and that's why they purchase from you - how you treat them. If you treat them well, then they'll have no reason to switch allegiance to your copycat producer.

im trying to protect a clever idea that has yet to be done
say u have a specific group of people with a specific interest, i dont know, say skydiving and say (here's the imaginary part) there were lots of special stores that catered to all things skydiving and say every city and town had one of these stores and say i wanted to sell wristbands with an individual's number of jumps debossed on each band.

in a perfect world, if i had no competition and no one else could sell the exact same sort of bands to the exact same niche, i would be very pleased

of course as u said anyone can make these bands no problem

is their any action i should/can take to better my odds of eliminating competition?

(and to answer ur other question) i want to be in this business as i see a need in a particular niche and a good possibility that this product would be desirable to this niche. and also a good possibility that someone else will think its a good idea too. it just so happens its a unique niche and the wristband craze never hit it (and im not interested in hearing about how people dont want wristbands)

but all this information has been very helpful so far, thanx and any more advice is very appreciated
