Can I Use Another Brands Name In An Ad?

Posted by Anonymous on 125 Points
I'm working with a flooring company... a local well known and respected business... which has nothing to do with flooring... in the area... remodeled their building... this was a very noticeable change... and has created a it of local buzz... to ride the wave of the buzz we were thinking something like:

I was floored by OTHERBIZ new look?
Were you floored by OTHERBIZ new look?

Can this be done legally? Again we aren't comparing brands, making false allegations, etc. Simply want to use their name.

Thoughts?

Even if it's perfectly legal, I would still ask OTHERBIZ first. If you don't and they feel compromised in some way, you will have a real PR nightmare on your hands. Chances are they'll say, "Sure, go ahead," and then you simply confirm their agreement (in writing) and proceed.

I am not an attorney and this is not legal advice.
