Canada Anti-spam Laws

Seeking legal/regulatory expert for counsel about e-mail marketing compliance with Canada anti-spam laws. We have a client that deploys e-mail campaigns to prospects and clients in Canada. Given the new laws, we want to be certain we are in compliance. Are there any guidelines they should follow?

    Heeey my friend roid,

    First of all my disclaimer...I am not an expert on the email laws of Canada and I am not a lawyer...but I still have some good news for you.

    The Direct Marketing Association at https://www.theedma.org put out a pdf document that guides you through and outlines everything they believe you should know about the new email laws in Canada.

    They have a committee at their organization who created this guide. So I would highly recommend if there is anything you do not understand about the guide or any questions you have about it that you would direct your questions to this committee. They are known as the Email Experience Council…eec for short.

    Mr. Dennis Dayman, is the Vice-Chair of the eec Member Advisory Committee and the eec Advocacy Subcommittee members are April Mullen, Sr. Email Marketing Strategist at DEG and Michelle Wimmer, Client Services and Media at IMM.

    One question, where is your client located? If he is outside of Canada, I would like to commend them for taking the initiative to comply to Canadian laws, so many companies outside of Canada that send messages into Canada do not.

    You will find all kinds of resources there to help you help your client. In fact, you may even want to email someone via this web site for some one on one support. You'll find that we Canadians do welcome questions, even from firms outside Canada. Since the fines can be as high as 10 million dollars (which is a lot of money to continue fighting spam), you may as well go straight to the horse's mouth and get some value for that fine money.
